However, it is important to note that India has strict labour laws aimed at the protection of the labour force. Indian labour laws are a complex web of central legislations as well as numerous state and local legislations, several of which could be applicable to an employer. We have a keen understanding of the Indian labour laws which we bring to bear in advising our global clients in relation to their Indian workforce, so as to maintain harmonious labour relations in India.

Our Indicative Experience

Advised Circor International on legal strategy and liability risk management with respect to industrial relations in connection with the shut down of one of its factories in the Indian state of Gujarat and the consequent consolidation of its Indian labour force at one location in the Indian state of Tamil Nadu.

Advising on a variety of employment law matters including employment bonds, whistle-blower complaints, terminations, employee disputes, and so on.

Drafting, reviewing, and advising on employee handbooks, employment agreements, non-compete and non-solicit agreements, and so on.

Conduct extensive audits on various internal policies, including privacy and data protection policy, environmental, social, and governance (ESG) policies, employee handbooks, etc. including for several clients including Circor International, CallidusCloud, Bright Horizons Childcare, and Udacity.

Regularly draft and review employee stock option policy documentation, including the ESOP policy, Board and shareholder resolutions for approving the ESOP policy, Board resolutions approving the award of options, communications with employees relating to the award/grant, and so on.

Advising on compliance with the Sexual Harassment of Women at Workplace (Prevention Prohibition and Redressal) Act, 2013, including reviewing policies and advising on the grievance redressal process to be followed by the internal complaints committee.
